Terms of Service

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1) Entertainment-only; no real-money gambling

• The Service is a free-to-play, entertainment-only social game experience.
• No real-money gambling: you cannot wager real money and you cannot win real money.
• No cash-out and no prizes of real-world value are offered through the Service.

2) Virtual currency and virtual items

• Any in-game credits, coins, points, or items are virtual ("Virtual Items").
• Virtual Items have no cash value, are not legal tender, are not redeemable for money or goods, and may not be transferred, sold, or exchanged outside the Service.
• If the Service offers optional purchases, they grant a limited, revocable licence to use Virtual Items in the Service only. All sales are final to the extent permitted by New Zealand law.

3) Eligibility and your responsibilities

• You must be at least 18 years old (or the age of majority where you live) to use the Service.
• You must use the Service lawfully and must not cheat, exploit bugs, use bots, or interfere with security or other users.
• You are responsible for your device, network access, and keeping any account credentials secure.

4) Intellectual property

The Service, including software, content, branding, and design, is owned by or licensed to NZ Play Viax Limited and is protected by intellectual property laws. You may not copy, modify, reverse engineer, or redistribute any part of the Service except as permitted by law or with our written consent.

5) Availability, changes, and termination

We may update, suspend, or discontinue the Service (or any features) at any time. We may suspend or terminate access if we reasonably believe you breached these Terms or to protect the Service, other users, or our rights. Upon termination, your right to use the Service and any Virtual Items ends.

6) Disclaimers

To the extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind. We do not warrant uninterrupted operation, error-free gameplay, or that Virtual Items will always be available.

7) Limitation of liability

To the extent permitted by New Zealand law, NZ Play Viax Limited is not liable for indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, or goodwill arising from your use of (or inability to use) the Service. Our total liability for any claim relating to the Service is limited to NZD $100, unless a higher liability cannot be excluded or limited under applicable law.

8) Disputes; New Zealand law and jurisdiction

If you have a concern, contact us first and we will try to resolve it. These Terms are governed by the laws of New Zealand. You submit to the non-exclusive jurisdiction of the courts of New Zealand, and the courts sitting in Auckland, New Zealand.

9) Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect means you accept the updated Terms.
